Astonishingly, the Florida Second District Court of Appeals held that the madatory minimum sentence in Paey's case did not violate the cruel and unusual punishment provisions of the constitution. They do violate equal protection because they cause people to be punished more severely for the Tylenol than the prohibited drug!
